1. Acceptance of the Terms of Use
By accessing and using the AMPEXT® website (ampext.com), including any content, functionality, and services offered on or through the site, you (the Customer) enter into a binding agreement with American Plant Extraction, LLC ("AMPEXT®"). Your order placement signifies your immediate, complete, and unconditional acceptance of these Terms of Use, which encompass the outlined terms along with any documents explicitly incorporated by reference.
2. Use of Website
As a customer making a purchase through ampext.com, I agree to adhere to the following terms:
2.1 Shipping Terms
- 2.1.1 All orders are shipped from FL, USA, using USPS (United States Postal Service), UPS, Fedex or DHL.
- 2.1.2 Customers are responsible for any additional shipping costs due to incorrect addresses or refused shipments.
- 2.1.3 Ampext® is not liable for packages detained by Customs.
- 2.1.4 All international fees, including customs duties, clearance charges, brokerage fees, and taxes, are the customer's responsibility. The buyer is also responsible for all costs and risks associated with customs clearance and delivery from the seller's premises to the destination.
- 2.1.5 Delivery times for international orders are not guaranteed and are at the customer's risk. A tracking number will be provided as confirmation of shipment. Once a package leaves our post office, AMPEXT® is no longer responsible for its delivery, including timing, customs clearance, or any loss or damage during transit.
2.2 Discreet Shipping
All orders are processed securely and with discretion. Providing accurate contact, billing, and shipping information ensures a smooth transaction. Missing information may delay processing until all details are confirmed. Orders are packaged in secure, unmarked containers without any indication of the contents.
2.3 Free Shipping
Free shipping is available for all orders over $50.00 placed within the continental United States, Hawaii, and Alaska. This option is not available for international addresses.
2.4 Returns
2.4.1. To initiate a return, customers should request a Return Merchandise Authorization (RMA) number through their customer profile's order history page or by completing the form on our Product Returns page. Customer Support is also available for assistance.
2.4.2. Returns are accepted under the condition that the product is returned in its original state within 30 days of receipt for a refund, replacement, or exchange for any retail sized product (2 oz and 4 oz).
2.4.3. Returns due to our error are authorized if reported within 7 days of receipt.
2.4.4. Open products, for health, safety, and medical reasons, cannot be returned, restocked, or refunded. Consumable products must be destroyed if returned to ensure safety and compliance.
2.4.5. Shipping costs are non-refundable. The actual cost of shipping may be deducted from your refund, even if the order qualified for free shipping.
2.4.6. Wholesale products must be returned within 14 days in their original condition with safety seals intact. A 15% restocking fee of the total order amount applies and will be deducted from your refund along with the actual shipping cost.
2.4.7. Orders can be canceled within 24 hours after payment. Once processed and marked as "shipped," cancellations are not possible.
2.4.8. Refunds for processed orders can be requested by refusing the package upon delivery or returning it. Refunds are issued once the returned package is received.
2.4.9. A 15% restocking fee applies to refused orders as compensation for processing, packing, and shipping preparations already made.
2.4.10. If the return is due to our error in fulfilling the order, return shipping costs are covered by us.
2.4.11. For returns not due to our error (e.g., change of mind), return shipping costs are the customer's responsibility.
2.5 Wholesale Orders
2.5.1. Wholesale orders require a 'signature upon delivery.' If a package is returned due to the absence of a signature or other controllable reasons, and re-shipping is requested, the customer will cover all re-shipping costs. A 15% restocking fee applies to refunds instead of re-shipment.
2.5.2. Before placing a wholesale order, customers are advised to order a retail sized product for testing to ensure product suitability and compatibility. A 15% restocking fee applies to returned wholesale products.
2.6 Refund Policy
2.6.1. Refunds are available if the order was placed by mistake and neither the shipping label has been purchased nor the product shipped. Once a shipping label is purchased, orders cannot be canceled or refunded. Rejecting the parcel upon arrival allows for a refund once it is returned.
2.6.2. Damaged products can be refunded or replaced. Proof, such as photos of the damaged items and parcel, is required.
2.6.3. If received items differ from the invoice, a refund or replacement is available. Incorrectly fulfilled items must be reported within 7 days with photographic proof.
2.6.4. Wholesale products are not eligible for refunds based on taste, color, smell, consistency, or individual adverse reactions unless returned unopened, with seals intact.
2.6.5. For non-wholesale orders, a refund request is acceptable if no more than one bottle of multiple items of the same kind has been opened. Refunds apply to both opened and unopened products. In certain cases, returning opened products for internal review may be requested.
2.6.6. Refunds are processed within 1 to 2 business days to the original payment method. Processing times may vary by financial institution.
2.7 Chargeback Claims
2.7.1. Chargeback claims require supporting documentation, including proof of return shipment and evidence of damaged goods.
2.7.2. Customers agree to attempt to settle disputes with AMPEXT® before initiating a chargeback, providing relevant documentation and reasons for refund requests.
2.7.3. Unauthorized chargeback claims are those where the customer has not attempted to resolve the issue with AMPEXT®, is unreachable, or has not contacted us via email or support chat.
3. Legal Disclaimer
3.1. Our products are herbal dietary supplements and have not been evaluated by the Food and Drug Administration. They are not intended to diagnose, treat, cure, or prevent any disease. The information and statements provided are for educational purposes only and are not meant to replace the advice of your treating doctor. We recommend consulting a physician before using our or any herbal supplements. AMPEXT® does not offer medical advice, prescribe, or diagnose illness.
